Terms and Conditions

1. Acceptance of Terms

By accessing or using the Reviewer Portal of the Mobilab Connect Platform ("Platform"), you ("Reviewer") acknowledge that you have read, understood, and agreed to these Terms & Conditions ("Terms").

If you do not agree, you must not access or use the Platform.

2. Role Definition

The Reviewer is an individual authorized by the Client organization (clinic, hospital, or diagnostic partner) to review and approve laboratory test results generated by Mobilab devices through the Mobilab Connect Platform.

Reviewers may fall under either of the following categories:

  1. Reviewer-Pathologist: A qualified and licensed pathologist responsible for final clinical validation of results and report sign-off.
  2. Reviewer-Non-Pathologist: An authorized user from the client's team (e.g., medical officer, MLT, or administrator) permitted to review and pre-approve results without providing any clinical sign-off or signature.

3. Purpose of the Platform

The Mobilab Connect Platform provides a technical interface to review, manage, and track test results generated by Mobilab devices.

It is a data facilitation tool and not a medical or diagnostic decision system.

The Platform assists users in workflow management; all clinical judgment, interpretation, and certification rest solely with the authorized medical professional.

4. Reviewer Responsibilities

4.1 Common Responsibilities (All Reviewers)

  • Review and verify test results displayed on the Platform.
  • Approve, reject, or request repetition of tests based on their organization's workflow.
  • Maintain patient data confidentiality and comply with applicable data protection laws.
  • Use the Platform solely for authorized purposes and within the scope granted by the Client.

4.2 Additional Responsibilities (Reviewer-Pathologist)

  • Confirm that they hold valid medical registration and are authorized to certify laboratory reports.
  • Accept full professional responsibility for the clinical accuracy and interpretation of approved results.
  • Understand that their digital signature on the Platform constitutes a formal clinical endorsement.

4.3 Additional Responsibilities (Reviewer-Non-Pathologist)

  • Understand that approval actions are administrative or preliminary only.
  • They cannot attach, use, or upload any digital or physical signature in the report.
  • Their approvals do not represent a clinical certification or a diagnostic conclusion.
  • The final report must be validated and signed by a qualified Pathologist appointed by the Client.

5. Disclaimer of Liability

1. Mobilab and its affiliates shall not be liable for:

  • Any clinical decision, diagnosis, or medical advice based on data reviewed or approved via the Platform.
  • Errors, omissions, or misinterpretations arising from device data, reviewer actions, or client processes.
  • Any claim related to the accuracy or completeness of results reviewed by a non-pathologist user.

2. Mobilab provides data visualization and workflow tools only; the Client and Reviewer bear full responsibility for the correctness and clinical use of results.

6. Data Confidentiality and Security

  • All patient data handled through the Platform is stored securely.
  • Reviewers must protect their login credentials and shall not share access with unauthorized persons.
  • Mobilab is not liable for data breaches, misuse, or unauthorized access caused by user negligence.

7. Digital Signature & Authentication

  • Only Reviewer-Pathologists may use digital or physical signature for report validation.
  • Reviewer-Non-Pathologists are prohibited from uploading or applying any signature.

8. Auto-Approval Configuration

  • The Client or authorized Reviewer may configure auto-approval rules (e.g., Green/Yellow Zone logic) where applicable.
  • Enabling auto-approval constitutes consent that reports will be approved without manual review during the defined window.
  • Mobilab bears no liability for results auto-approved under these configurations.

9. Indemnification

The Reviewer and Client agree to indemnify, defend, and hold harmless Mobilab, its directors, employees, and affiliates from any and all claims, damages, or losses arising from:

  • Misuse or misinterpretation of reviewed data.
  • Unauthorized issuance of reports or digital signatures.
  • Breach of applicable medical, data protection, or professional laws.

10. Limitation of Liability

To the fullest extent permitted by law:

  • Mobilab's total liability shall not exceed the subscription or access fee (if any) paid for the Reviewer Portal or Test cost for the specific patient.
  • Mobilab shall not be liable for indirect, consequential, incidental, or punitive damages, including misdiagnosis, loss of data, or business interruption.

11. Access Suspension or Termination

Mobilab reserves the right to suspend or revoke access if:

  • The Reviewer violates these Terms or uses the Platform beyond its intended purpose.
  • The Client's subscription or license expires or is terminated.
  • Required verification or licensing documentation is invalid or outdated.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of India, and any disputes shall be subject to the exclusive jurisdiction of the courts of New Delhi, India.

13. Acknowledgement and Consent

By proceeding, the Reviewer confirms that:

  • They understand their role and limitations as defined above.
  • They assume full responsibility for their review actions and approvals within the Platform.
  • They acknowledge that Primary Healthtech Pvt. Ltd. (Mobilab) is not liable for any clinical, legal, or operational outcomes resulting from their use of this system.
